According to the Order of the Ministry of Health of Ukraine No. 360 dated July 19, 2005, "On the Procedure for the Sale of Medicinal Products and Medical Devices from Pharmacies and Their Structural Units", and the Resolution of the Cabinet of Ministers of Ukraine No. 172 dated March 19, 1994 "On the Implementation of Certain Provisions of the Law of Ukraine 'On Consumer Rights Protection'":

Medicinal products, hygiene items, and medical devices of proper quality that have been dispensed from pharmacies and their structural units are not subject to return.

In accordance with Article 8 of the Law of Ukraine "On Consumer Rights Protection": "In case of identifying, within the established warranty period, significant defects that arose due to the fault of the manufacturer (seller, provider), or in case of product falsification, confirmed, if necessary, by an expert examination, the consumer, under the procedures and within the deadlines established by law, and based on mandatory rules or the contract, has the right to demand from the seller or manufacturer, at their own choice: 1) termination of the contract and refund of the amount paid for the product; 2) replacement of the product with an identical or similar product available from the seller (manufacturer)."

To return a low-quality medicinal product to the pharmacy, the consumer must provide not only the fiscal receipt obtained during the purchase of the product at the pharmacy but also proof that the medicinal product is of inadequate quality, i.e., does not meet the manufacturer’s stated requirements.

The competent authority in the field of quality control of medicinal products is the State Service of Ukraine on Medicines and Drug Control (State Medicines Service).

Upon receiving their order from the courier, the customer (consumer) has the right to refuse the delivered medicinal product and demand a refund without paying for the delivered product and/or delivery services, or demand proper fulfillment of the order if:

  • the primary and/or secondary packaging of the medicinal product is damaged;
  • the expiration date of the medicinal product has passed;
  • the authorized authority has issued a ban on the sale and use of the medicinal product;
  • the delivered order does not match the ordered items in terms of quantity, composition, name, dosage, release form, or price.
